By-law 59 - Use and Occupancy Restrictions

(a)  In this clause:

   (i)  "occupant" means a person present in a Unit or in or upon the real or personal property of the Corporation or the Common Property with the permission of an Owner.

   (ii) "Owner" includes a tenant or guest

(b)  An Owner shall not:

   (i) use his Unit or any part thereof for any purpose which may be illegal or injurious to the reputation of the condominium project or for a purpose involving the attendance of the public at such Unit;

   (ii) keep or allow any animal other than small dogs (16"in height or less), cats, fish or birds which shall either be kept inside the residence or between the hours of 7:00am and 10:00pm maybe outside the residence if on a hand leash in actual control of one of the occupants of the unit;

   (iii) have any garden

   (iv) except for professionally designed "For Sale" signs, erect, place, allow, keep or display signs, billboards, advertising matter or other notices or displays of any kind in or about any Unit without the prior approval of the Board;

   (v) make or permit noise in or about any Unit or the Common Property which in the opinion of the Board is a nuisance or unreasonably interferes with the use and enjoyment of a Unit or the Common Property by any other Owner or occupant.  No instrument or other device shall be used within a Unit which in the opinion of the Board caused a disturbance or interferes with the comfort of other Owners;

   (vi) permit laundry to be hung outside the Unit;

   (vii) erect or place any building, structure, tent or trailer, (either with or without lving, sleeping or eating accommodation) on the Unit, without the prior approval of the Board;

   (viii) permit, erect or hang over or cause to be erected or to remain outside any window or door or any other part of a Unit or on the Common Property, clothes lines, garbage disposal equipment, recreational or athletic equipment, fences, hedges, barriers, partitions, awning, shades or screens or any other matter thing without the consent in writing of the Board first had and obtained.  No satellite dishes, televisions or mobile telephone or radio antenna tower or similar structure or appurtenances thereto shall be erected on or fastened to any Unit except in conformity with the Restrictive Covenant

   (ix) store any combustible, inflammable or offensive goods, provisions or materials in his Unit, or on the Common Property

   (x) do anything or permit anything to be done in his Unit, thereto or upon the Common Property or the real or personal property of the Corporation or fail to do any act or thing which will or would tend to increase the risk of fire or the rate of fire insurance premiums with respect thereto or which would render invalid any insurance maintained by the Corporation;

  (xi) do anything or permit anything to be done by any occupier of his Unit in his Unit, or the Common Property that is contrary to any statutes, ordinance, By-law or regulation of any government authority whether Federal, Provincial, Municipal or otherwise;

   (xii) do or permit anything to be done that may cause damage to trees, plants, bushes, flowers or lawns or to interfere in any way with the cutting of the lawns or the maintenance of the grounds generally on any Unit, or the Common Property;

   (xiii) deposit refuse or garbage outside his Unit other than in proper garbage containers as directed by the Board;

   (xiv) permit any member of his household, guests, invitees, licensees, agents or visitors to trespass on another Owner's property or on any part of the Common Property to which another Owner is entitled to exclusive occupation;

   (xv) use any part of the Common Property for the parking of any motor vehicles or other items except in accordance with permission in writing from the Board;

   (xvi) allow trailers, campers, boats, snowmobiles, trail bikes, all terrain vehicles, motor homes or equipment to be parked or stored;

   (xvii) park motor vehicles otherwise than on the front part of the unit between the residence as constructed and the property line for the Unit.  No non-operative or unregistered vehicles shall at any time be parked within the Unit;

   (xviii) drive any motor vehicle on the Common Property at a speed in excess of 15 kilometers per hour;

   (xix) obstruct or permit any entry, roadway, walkways or driveways or parking areas to be obstructed by his family, guest or visitors;

   (xx) allow his Unit to become unsanitary or unsightly in appearance;

   (xxi) store garbage or trash outside his residence or garage; dumpster on site;

   (xxii) permit a contractor or workman to do any work in his Unit that would disturb any residents between the hours of 6:00pm and 8:00am or on Saturdays, Sundays or legal holidays without the prior consent of the Board;

To the extent there is any inconsistency between these provisions and the Restrictive Covenant the Restrictive Covenant shall prevail.
